Mr. MA was recognized as the 2013 Leading IP Practioner by Beijing Bar Association and received the prestigious IP business Innovation Special Achievement Award from the Intellectual Property Commission of National Bar Association. He is also recognized as one of the top and distinguished IP lawyers in China by Managing Intellectual Property (MIP) Magazine in 2015. Thomson Reuters Asian Legal Business (ALB) highly regarded Mr. MA’s IP practice and listed him as the Top 20 Client Preferable IP Lawyers in China in 2016. In addition, Mr. MA is named as the Most Recommended IP Lawyers by Chambers & Partners in 2017 referring him as “a specialist in patent and trade mark disputes”, "client’s highlights: extract the main points within a short period of time", "being very responsive, even if it is 10 or 11pm." In 2017, Mr. MA continued to be nominated by Managing Intellectual Property as IP Stars covering the areas including Trade Mark Filing & Prosecution, Trade Mark Litigation, Copyright, Designs and IP Transactions.
Mr. MA is very active in many bar associations and has chaired various committees for the IP Section of the National Bar Association. He is included in the Expert Database of National Intellectual Property Strategy, and invited as an expert participating in the legislative amendments of the Trademark Law, Patent Law and Anti-unfair Competition Law.
Shenzhen Proview Technology Inc v. Apple Inc
Represented Shenzhen Proview as the chief litigation counsel in the famous and influential “iPad” trademark infringement litigation against Apple Inc. Braving tremendous pressure from the public, Mr. MA represented Proview in Appellate court session and played an active and key role in leading the negotiations between both parties then resulting into the deal most favorable to his client Proview. Following a 2 year trial and various rounds of negotiations, Proview and Apple Inc eventually came to a $60 million settlement fees under the mediation of Guangdong High Court as a result of Mr. MA’s team’s extraordinary ability in organizing case materials, analyzing materials against legal standards, writing briefs and developing advocacy strategy and handling pressure from the profession. Shenzhen Proview Technology Inc v. Apple Inc has been selected as the leading case among the 10 Major Cases issued by Supreme People's Court on Judicial Protection of Intellectual Property Rights in 2012.
Michael Jordan v. Qiaodan Sports Co., Ltd
Another highly controversial and well noted case of Mr. MA. Mr. MA served as the chief litigation counsel for the Qiaodan Sports in the defense of the company’s Qiaodan related trademarks in 50 administrative litigations (in both Intermediate and High Courts) filed by Michael Jordan, and against infringements upon using celebrity’s name without authorization. Mr. MA obtained the best results for Qiaodan Sports by successfully maintaining over 80 marks for Qiaodan thus saving the company at stakes. This case was widely discussed in various international IP forums including MIP and INTA. Michael Jordan v. Qiaodan Sports Co., Ltd has been selected by Supreme People's Court among the 10 Major IP Cases in 2016; and among the 10 Major cases fostering the Rule of Law that co-launched by Supreme People’s Court and China Central Television.
Huawei Technologies Co., LTD v. ZTE Communications Co. , Ltd & Hangzhou Alibaba Advertising Co., LTD
Mr. MA served as the lead counsel for the plaintiff Huawei in the Supreme Court retrial procedure in alleging that a switch ZTE manufactured, offered to sell and sold infringed its patent of Huawei’s DHCP method, and Alibaba sold said switch.
The case is one of the Top 10 IP Cases of National Bar Association in 2015.
