Overview

Founded in 1997, PE Lim is a dispute resolution-focused boutique firm. While headquartered in Petaling Jaya, the firm handles contentious matters across Kuala Lumpur, Shah Alam and Klang. The firm’s dispute resolution team is regularly engaged as counsel in appellate cases before the Court of Appeal and Federal Court, advising on constitutional and commercial issues. The firm is also active in commercial transactions, construction, insolvency and employment disputes. Founder Pek Eng (Judy) Lim has extensive experience appearing before all levels of Malaysian courts. Work highlights 

Acted as counsel for a major Penang property developer and its director, successfully opposing an application for permission to take a case concerning the tort of abuse of process to the Federal Court. There is currently no reported Federal Court ruling in Malaysia relating to this tort, and Singapore has recently found that it no longer recognises the tort. Against this backdrop, the firm successfully argued against the applicant’s bid for permission to appeal to the Federal Court. 

Acted as co-counsel for five directors of a major Selangor-based jewellery company, successfully opposing a civil appeal in the Court of Appeal. This was a potentially landmark case as there were no existing Court of Appeal rulings on whether the omission of an arbitration seat and applicable procedural rules renders an arbitration clause void for uncertainty.
