Criminal Defence & Public Interest Litigation
Our firm is unique in that we are also adept at handling criminal defence litigation work. Because of this, we are especially skilled in the art of cross-examination. At the highest Court levels, we have pursued novel lines of argument, broke ground, and persuaded the Courts to make new law.
We are a go-to firm for public interest litigation. For instance, we acted for the appellant in the recent Court of Appeal (“CoA”) case of Nagaenthran a/l Dharmalingam v Public Prosecutor  SGCA 37. In that case, we argued among other things that Section 33B(4) of the Singapore Misuse of Drugs Act (“MDA”), which provides that no proceeding shall lie against the Public Prosecutor in relation to determinations by the Public Prosecutor under Section 33B(2)(b) of the MDA, was an ouster clause and violated the Article 93 of the Constitution and the constitutional principle of separation of powers. Eventually, the CoA held that Section 33B(4) of the MDA, properly construed, did not limit the courts’ power of judicial review of the Public Prosecutor’s determinations under Section 33B(2)(b) of the MDA. However, in obiter remarks, the CoA observed that if Section 33B(4) were to be construed as limiting judicial review, that provision would then indeed be constitutionally suspect for violating Article 93 and the separation of powers.
The pursuit and defence of fundamental liberties is a core ethos of the firm. We lend our support to organisations and movements which are similarly-minded (eg. Pink Dot SG).

Acted for Broadley Construction in its appeal against Alacran Design on a contractual dispute.
Acted for Weyland Tech, a US-incorporated company and its CEO, Brent Suen in litigation involving several counterparties arising out of acquisition agreement terms.
