Tougher competition legislation will enter into force in Thailand on October 5. Important features of the Trade Competition Act include a dual merger approval system, the ability for the Competition Commission to impose criminal sanctions and an expansion of the scope of businesses covered, including state-owned enterprises. Though a competition law has been in place for the past 18 years, the authorities have never used it to prosecute anyone. The ineffectiveness of the existing law has prompted them to strengthen regulations.

While some believe this to be Trump’s way of forcing China to increase pressure against North Korea to stop developing nuclear weapons, others think Trump’s concern about how IP theft is affecting US businesses is genuine.

Indonesia has drafted a new competition law that contains heavier fines for businesses convicted of competition, more enforcement power for the competition authority and the introduction of a leniency programme. While the regulator has been struggling to get the law to parliament for a number of years, it is now thought to have enough support to be to be passed later this year.
