The Government passed the Employment and Retirement Schemes Legislation (Offsetting Arrangement) (Amendment) Bill 2022 on 9 June 2022 to abolish the use of the accrued benefits of employers' mandatory contributions under the Mandatory Provident Fund (“MPF”) System to offset severance payment (“SP”) and long service payment (“LSP”). While this development is welcome by employees, certain preparation should be made by Hong Kong employers especially for those whose workforce experiences low turnover.

On April 22, 2022, Chengdu International Commercial Court was officially established. It is the third international commercial court in China after the establishment of the Suzhou International Commercial Court and the Beijing International Commercial Court, and exercises centralized jurisdiction over the first instance proceeding of all foreign-related civil and commercial cases that should have been heard by intermediate people’s courts within Sichuan Province.

In the recent Court of Appeal case of Star Cruise Services Limited v Chen Teng Fah (unreported), Star Cruise succeeded in obtaining summary judgment against a patron to recover a debt pursuant to a gaming credit facility. There have todate been no reported Court of Appeal decisions in respect of the grant of summary judgment on a “gaming” debt matter.
